1 Hal Merchant (plaintiff) and Groendyke Transport, Inc. (defendant) entered into a written agreement whereby plaintiff leased certain motor vehicle equipment to defendant for a term of five years beginning July 1, 1957. The parties made a simultaneous oral agreement for a like term whereby plaintiff would serve as defendants representative and terminal manager at Duncan, Oklahoma. Plaintiffs income was provided for in the written agreement as a certain percent of the gross revenue produced by plaintiffs equipment less expenses of operating the equipment.
